Terms of Service

1. Agreement to Terms

By accessing or using CallClarity ("the Service"), operated by Butler Endorsed LLC ("we", "our", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

CallClarity is an AI-powered call intelligence platform for service businesses. The Service provides:

  • A dedicated phone number for your business
  • Call forwarding to your phone
  • Automatic call recording and transcription
  • AI-powered call analysis and summarization
  • Notifications via email and SMS with call summaries

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account.

4. Call Recording Consent

The Service records all calls routed through your CallClarity number. A recording notice is played at the beginning of each call. By using the Service, you acknowledge and agree that:

  • All calls will be recorded
  • A recording notice is automatically played at the beginning of each call to inform all parties

5. SMS Notifications

By providing a text notification number during activation, you consent to receive SMS messages from CallClarity containing call summaries and service notifications. Message frequency varies based on call volume. Message and data rates may apply.

To stop receiving messages, reply STOP to any message. To get help, reply HELP or email support@callclarity.io. You can also opt out at any time by removing your notification number from your account settings. Carriers are not liable for delayed or undelivered messages.

6. Subscription and Payment

  • The Service is offered at the subscription rate displayed during checkout
  • Payment is processed securely by Stripe
  • Your subscription renews automatically each month until canceled
  • You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
  • Refunds are not provided for partial billing periods

7. Fair Use

Each subscription plan includes a monthly allocation of AI-analyzed call minutes as described during checkout. Usage significantly exceeding your plan limit may result in a request to upgrade or adjust usage. We will notify you before taking any action.

8. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Record calls without proper consent where required by law
  • Send unsolicited or spam SMS messages through the platform
  • Interfere with or disrupt the Service or its infrastructure
  • Resell or redistribute the Service without written permission

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service depends on third-party providers including Twilio, AWS, and Anthropic. We are not liable for downtime or service interruptions caused by these providers.

10. Limitation of Liability

To the maximum extent permitted by law, CallClarity and Butler Endorsed LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

11. Termination

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. After cancellation, your dedicated phone number is held for a grace period so you can reactivate without losing it; after the grace period, the number may be released. We may also suspend or terminate accounts that violate these Terms.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. Material changes will be communicated via email.

13. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.
